Description:

The Discipline and Capacity Committee is mandated to hear allegations of professional misconduct, incompetence or incapacity referred to it from the Complaints Committee, to make determinations of guilt or incapacity and to apply the appropriate and just remedy to the member who is the subject of the allegation(s).

The Discipline and Capacity Committee is comprised of designated members, public representatives and legal counsel. 

Qualification & Skills:

Currently the Discipline and Capacity Committee is seeking designation holding registrants (CHRP, CHRL, CHRE) and individuals who are lawyers for the committee. 

These individuals should have experience working on regulatory adjudicative committees or a background in HR law is preferred, but not required. Additionally interested applicants should have the following attributes:

  • Understanding of hearings
  • Understanding capacity examinations
  • Understanding how to deal with expert reports and expert opinions.
  • A deeper understanding of HRPA’s Code of Ethics and Rules of Professional Conduct
  • Understanding of the options available to the Committee and when each option would be appropriate.

Time Commitment:

As a member of the Discipline and Capacity Committee, you would be called upon to attend hearings on an as-needed basis.  Although hearings are rare at the HRPA, the process for a single case can involve multiple hearings over the course of months.  As such, it is difficult to predict the time commitment that this role will require; however, a rough estimate would be 12 hours per year of hearings, during business hours.  Furthermore, given the nature of cases, once you’re are assigned to a panel your attendance at hearings is mandatory. 

In addition to hearings, you will be required to attend an annual 3 hour business meeting, either in person or virtually. Currently all hearings, training and meetings are conducted remotely. Travel to HRPA’s Toronto office may be required in the future.

Please note that any committee appointment would be conditional on the completion of the Boot Camp. The Boot Camp will be recorded and archived for individuals who are not able to attend the live recording.
